PRIZE DRAW TERMS AND CONDITIONS

By entering into the prize draw, you will be deemed to have accepted these terms and conditions.

1. The prize draw is open to any private individual who is resident in the UK and is aged 18 years and over, other than any employees of Earth Mobile Ltd (“Earth Mobile”) or their immediate relatives.

2. To enter the prize draw you need to send your old mobile phone in working order to Earth Mobile and answer the question set out in the accompanying card or on the website entry form. Up to 5 entries per household is permitted.

3. The draw will take place on receipt by Earth Mobile of the 25,000th mobile phone.  The prize winners will be randomly selected from all entrants sending in a working mobile phone and answering the question correctly.

4. There are 3 cash prizes.  First Prize is £7000, Second Prize is £2,000 and Third Prize is £1,000.

5. All prize winners will be formally notified by letter by first class post and/or by e-mail to the address provided by the relevant prize winner.  This letter will set out details of how the prize can be claimed.  All prizes must be claimed within 14 days of the date of notification.

6. No other alternative will be offered in place of the stated prizes.  The prizes are non transferable and non negotiable.

7. Earth Mobile’s decision on all matters affecting this prize draw is final and legally binding and no correspondence will be entered into relating to the prize draw.

8. You warrant that you are the legal owner of the mobile phone and have the right to send it to Earth Mobile.  You are solely responsible for removing the sim card and deleting all data from your mobile phone.  Earth Mobile is unable to return any mobile phone sent in error and/or to delete any data stored on the mobile phone.

9. Earth Mobile shall have no liability in respect of any entry that is lost in the post, incomplete, illegible or damaged and shall have no liability in respect of any mobile phone that is lost.  Proof of entry is not automatically proof of receipt.

10. Earth Mobile reserves the right to disqualify or refuse entry to anyone, who in its sole discretion, acts in a disruptive or unsportsmanlike manner.  Earth Mobile reserves the right to cancel the prize draw at any stage, if the prize draw is not capable of running for any reason (including but not limited to a failure to acquire 25,000 phones or due to any other circumstances beyond its reasonable control).

11. By entering the prize draw, all prize winners agree to their name, town and prize being published by Earth Mobile in any marketing material.

12. Any personal data that you provide to Earth Mobile (including but not limited to an your name, address or other contact details) will only be used by Earth Mobile for the purposes of administering the prize draw and our trading partners keeping you informed of any other recycling initiatives or mobile phone incentives that may be of interest to you.  Earth Mobile will comply with its responsibilities under the Data Protection Act 1998 and will not disclose your personal data to any third party except where required by law or by any regulatory authority.

13. These terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.
